An order under s 598 of the Corporations Act 2001 (Cth) requiring a person to pay money, made in winding up proceedings against a person who was not a party to those proceedings, is a final order for the purposes of appeal. In the ACT, the default position under r 5302 of the Court Procedures Rules 2006 is that no security for costs on appeal is required, and the rule does not expressly require special circumstances to be shown, though the applicant must make out the case for security. Impecuniosity of an appellant is an important and relevant factor but is not determinative.
