The 'subject matter' of a complaint under s 92(1)(a)(v) of the Anti-Discrimination Act 1977 (NSW) must be identified by reference to the substance of the complaint, not merely the event to which it relates. A complaint of unlawful dismissal on a discriminatory ground has a different subject matter from an application alleging unfair dismissal as harsh, unjust or unreasonable. The President of the ADB cannot decline a complaint of unlawful discrimination on the basis that the complainant's termination of employment has been the subject of an unfair dismissal application to the AIRC.
