The prohibition in s 62(1)(c) of the Mining Act 1992 (NSW) on the grant of mining leases over land on which improvements are situated operates independently of the claim mechanism in Schedule 1; a landholder's failure to make a claim under cl 23A within time does not abrogate the statutory protection. Section 75V(1)(c) of the EPA Act does not impliedly repeal s 62(1) because where there is no power to grant a mining lease (due to the statutory prohibition), no question of 'refusing' an authorisation arises. Service of documents on a corporation under s 383 of the Mining Act may be effected by post to any of the corporation's places of business, not only its registered office.
