A cleaning contractor's duty of care to third parties is determined by the scope of its contractual obligations. Where the contract requires only daily cleaning and the hazard arose within a period when no cleaning was contractually required, no breach causally connected to the injury is established. The Rose v Abbey Orchard probability approach to causation in slip and fall cases was endorsed by Hodgson JA (dissenting) but the majority did not need to address it.
