The availability of rectification is not a pre-requisite to finding that a contract for sale of land was formed where materially different counterparts were exchanged; the contract can be proved by evidence of the parties' agreement on terms and the act of exchange, without any order for rectification. A Notice to Complete giving less than 14 days requires special circumstances to be shown as reasonable. The District Court's limited equitable jurisdiction under s 134 of the District Court Act 1973 does not prevent it from finding a contract existed in these circumstances.
