An occupier may be liable for injuries caused by a fall from an elevated surface even where the plaintiff cannot identify the precise cause of the initial slip, provided the breach of duty (here, failure to clear or widen a narrow, cluttered, elevated space) created a foreseeable risk that any slip would result in a fall from the edge. Assessment of contributory negligence must take into account the practical opportunities for choice that the plaintiff had concerning his or her own safety.
