The period leading up to trial is when parties are often best positioned to consider a Calderbank offer, and a short period for acceptance (less than 2½ business days) may be adequate where the offeree has been on notice of the claim's basis and could have requested more time. A discount of approximately 30% on the total claim constitutes a genuine element of compromise. An offeree who fails to request additional time to consider an offer cannot later complain that the period was insufficient.
