Where unsuccessful defendants have themselves joined the successful defendant by cross-claim and denied liability before the plaintiff joined that defendant, this conduct is sufficient to justify a Sanderson order requiring the unsuccessful defendants to bear the successful defendant's costs. A Sanderson order is preferable to a Bullock order because it eliminates the risk of non-payment and is administratively cleaner.
