A court that strikes out a defendant's defence under UCPR r 12.7(2) or s 61(3)(c) of the Civil Procedure Act 2005 is not thereby empowered to enter a monetary judgment for the plaintiff without evidence substantiating the claim. An affidavit in support complying with UCPR r 16.6(2) remains necessary unless the court expressly orders otherwise under r 16.3(2) with reasons. Clear words would be required to warrant the conclusion that a provision authorising the striking out of a defence was intended to permit the court to act without evidence to substantiate a monetary claim.
