The standard non-parole period must be used as a reference point even where the offender has pleaded guilty, and the sentencing judge must assess where the offence falls in the range of objective seriousness. The Henry guideline for armed robbery (s 97) states a range below the appropriate range for armed robbery with wounding (s 98). The emphasis on rehabilitation in sentencing juveniles is subject to significant moderation where the juvenile has committed a violent adult crime. A plea entered on the day fixed for trial does not constitute a plea at the first opportunity warranting a full 25% discount.
