An offender's significantly worse criminal history, including prior convictions for indictable drug offences, is a sufficient basis to distinguish that offender from co-offenders for parity purposes and to justify a more severe sentence. The totality principle applied to a co-offender's sentence for a separate offence, and different subjective circumstances, may also explain apparent disparities.
