The practice of approaching sentencing appeals by searching for and comparing sentences in other cases is neither helpful nor supported by authority. Very serious s 193C proceeds of crime offences involving millions of dollars may not be appropriate for treatment as related summary offences under s 166 Criminal Procedure Act 1986. Sentencing judges must make findings of fact regarding serious related offences and must provide reasons for findings of special circumstances under s 44(2) Crimes (Sentencing Procedure) Act 1999.
