When a sentencing judge accumulates a sentence upon an earlier sentence imposed by a different judge who found special circumstances and adjusted the statutory ratio, the later sentencing judge is not obliged to adjust the ratio to the same extent or to maintain the balance of term set by the earlier judge. The non-parole period must itself appropriately reflect the criminality of the offences. The CCA will be very slow to intervene in the size of the adjustment to the statutory ratio.
