Where a conviction and sentence are quashed on appeal but the quashed sentence was served wholly concurrently with other sentences (such that no part of the overall term was served exclusively in relation to the quashed count), the overall sentence need not be reduced. The amended s 59 of the Crimes (Sentencing Procedure) Act 1999 (NSW) is facultative and does not compel restructuring of sentences to achieve the same overall result.
