An indecent assault not committed for sexual gratification is not necessarily less heinous than one so motivated; the categories of seriousness of indecent assault offences cannot be readily compartmentalised. Prior good character does not preclude a finding of gratuitous cruelty under s 21A(2)(f). The sex offender registration regime under the Child Protection (Offenders Registration) Act 2000 (NSW) may qualify as extra-curial punishment but warrants minimal weight in sentencing, particularly where annual reporting is the primary obligation.
