The degree of moderation of a sentence on account of an offender's mental condition is a discretionary determination for the sentencing judge. Where psychiatric evidence does not establish a significant degree of compromise in the offender's ability to appreciate the gravity of the offence, and the offender demonstrates a lack of remorse and tendency to blame the victim, the sentencing judge is entitled to limit the degree of moderation. The circumstance that a detention offence occurred in a domestic context does not lessen its gravity.
