The definition of 'identification evidence' in the Evidence Act 1995 Dictionary extends to recognition evidence (evidence by a witness who knows the accused). However, evidence of introduction and evidence of movements constitutes indirect evidence of presence and does not fall within the definition. Section 116 is not engaged where the accused's presence at or about the time of the offence is not in dispute, even if the precise details of the accused's movements are contested.
