Criminal Appeal Rules r 50C(2) permits applications to set aside or vary orders within 14 days of entry, but the Court exercises the same powers as if the order had not been entered, governed by the Autodesk (No. 2) criteria. An application to reopen a criminal appeal to present further evidence that was available but not presented at the hearing will be refused as an impermissible attempt to reargue the appeal.
