Statements made by a testator in a will, though admissible under s 32 of the Family Provision Act 1982 (NSW), may be contradicted by other evidence and need not be accepted as true. An adult child with significant health problems, mortgage debt, and limited earning capacity may be found to have been left without adequate provision even where the testator expressed reasons for limiting the provision. An order for provision is not made as a reward for services or good conduct, nor withheld as punishment for perceived bad conduct.
