Where a worker's incapacity results from or is materially contributed to by multiple injuries sustained at different times when different approved insurers were on risk, there is double insurance and the paying insurer may recover contribution from the other insurer under s 126A of the Work Health Act (NT). The NSW Court of Appeal decision in Manufacturers Mutual is overruled as wrongly decided. The six-month time period under s 126A(2)(b) runs from when a claim is made by the worker and the insurer accepts liability, not from when the insurer first becomes aware of the other insurer's potential liability. 'Has indemnified' in s 126A means 'has accepted liability under the policy', not that actual payment must have been made.
