The 90-day time limit for adjudication applications under s 28(1) of the Construction Contracts (Security of Payments) Act (NT) is not a jurisdictional precondition; an adjudicator's wrong determination that the application was within time does not render the determination void. A determination will be void only if the adjudicator did not make an honest attempt to decide the question or substantially denied natural justice. Section 20 of the Act implies Division 5 of the Schedule if the contract lacks a written provision about either responding to payment claims or the time for payment — the paragraphs are disjunctive.
