Where an offender bears no responsibility for excessive delay in sentencing which was productive of unfairness, that delay may be taken into account in mitigation whether or not it was attributable to any fault on the prosecution side. General deterrence is a relevant sentencing consideration for Commonwealth offences notwithstanding its omission from s 16A(2) of the Crimes Act 1914 (Cth). Sentences imposed in other jurisdictions for Commonwealth offences are of limited utility as comparables due to differing state/territory sentencing structures under ss 19AA and 19AZD of the Crimes Act 1914 (Cth).
