A solicitor is not negligent in failing to repeat advice already given and understood by an experienced client about the need to lodge caveats, where the retainer was limited to specific tasks and there was no circumstance suggesting the client had forgotten the advice. The Staughton J formulation in R P Howard Ltd v Woodman Matthews — that a solicitor must ensure that if a time limit expires it is the client's fault — is too onerous and inconsistent with the standard in Midland Bank.
