A superintendent appointed under a building contract does not carry out 'building work' within the meaning of s 42 of the Queensland Building Services Authority Act 1991 (as in force prior to 2007 amendments) and is not required to hold a contractor's licence. Section 42(2)(b) extends only to advisory, administration, management or supervisory services provided by a person who is himself carrying out building work, not to a superintendent who is not building. Even if a superintendent were found to have contravened s 42, the building contract would not be rendered illegal or unenforceable.
