The six-year limitation period in s 1317HD(2) of the Corporations Law for recovery proceedings by a corporation against directors who contravened civil penalty provisions is jurisdictional and cannot be extended under s 1322(4)(d). The absence of an internal extension mechanism within Part 9.4B does not, of itself, compel the application of s 1322(4)(d). The different treatment of limitation periods across the three recovery avenues in Part 9.4B is rationally explicable and not anomalous.
