An aggregate sentence is not appropriate where the presentment contains counts varying significantly in their seriousness or the manner in which offences were committed. In such cases, the sentencing judge must impose individual sentences with specified cumulation orders to maintain transparency. Where the aggregate sentence is set aside on appeal, the appellate court may impose the same total effective sentence through individual sentences but adjust the non-parole period.
