Where a direct right of recovery against the insurer of a deregistered company exists under s 601AG of the Corporations Act 2001 (Cth), an application for reinstatement under s 601AH will generally be dismissed unless special circumstances are established. Uncertainty about the identity of the insurer is not, without more, a sufficient special circumstance, particularly where any limitation period difficulty can be remedied by an order under s 601AH(3) at a later time.
