The term 'condition' in clause 13.5 of the General Conditions for the Sale of Land 2002 Revision refers only to conditions imposed by the WAPC itself at the time of granting subdivisional approval, not to requirements subsequently specified by other bodies whose satisfaction is necessary for compliance with the WAPC's conditions. The 10 business day termination period runs from notification of the WAPC's conditional approval. However, a party may, acting reasonably, elect to terminate within the 10-day period on the basis of a condition's generality or lack of specificity where the substantive content depends on another body's future determination. The question of whether an implied term of best endeavours to obtain information from other bodies exists was left open.
