Where a motor vehicle dealer acts as agent of the licensing authority under the Dealer Network Registration Scheme and determines that no stamp duty is payable on the issue of a licence, that determination constitutes an 'assessment' within s 13 of the Taxation Administration Act 2003 (WA). The Commissioner's subsequent assessments in respect of those licences are reassessments subject to the limitations in the TAA, but s 35 of the Consequential Provisions Act does not preclude such reassessments where the Commissioner could have assessed under s 31A(1)(c) of the old Stamp Act. Subsequent events, including actual use of vehicles, are admissible to determine the dealer's purpose at the time of licensing for the purposes of the s 76C(6) exemption.
