Under the Mining Act 1978 (WA), a warden's dismissal of an application for a miscellaneous licence — whether on abuse of process grounds, estoppel, or any other preliminary basis — constitutes a 'refusal' within s 94(3), giving rise to a right of appeal to the Minister. There is no distinction between 'dismissal' and 'refusal' for the purposes of the appeal right. A partial refusal is also appealable. The warden has no implied power to make unappealable decisions disposing of applications.
