A failure by a worker to prove a component of disability (such as psychiatric disability) in a first Form 22 application does not create an issue estoppel precluding a second Form 22 application addressing that component, because the failure to prove is not a 'solemn finding' as to the degree of disability. The definition of 'new information' in s 186 of the Act encompasses both information that was not available to the party at the time of the original decision and information that was available to the party but not disclosed to the arbitrator. Arbitrators must determine the worker's overall degree of disability on the material before them, rather than dismissing the application when one component of disability is not proved.
