A widow's claim under the Family Provision Act 1982 does not have automatic primacy over competing claims; 'widow takes all' is not a rule of law. In small estates, a life interest in the matrimonial home secured by an undertaking from executors not to sell may constitute adequate provision. Arguments that a trial judge gave too much or too little weight to relevant factors do not establish appellable error unless the factor was given 'little or no weight' amounting to a failure to consider it. Respondents to family provision appeals with no relevant conflict of interest with executors should not expect separate representation at the estate's expense.
