An order or agreement to pay 'the costs of the proceedings' ordinarily includes the costs of a court-ordered mediation under Part 4 of the Civil Procedure Act 2005 (NSW). Section 28 of the CPA does not create a special category of mediation costs requiring a separate express order or agreement. If parties intend to exclude mediation costs from a costs order, this must be made clear in the order.
