Medical reports must be analysed in their proper context, including the purpose for which they were prepared; a trial judge's finding of a 'consistent picture' from reports prepared for different purposes (superannuation, workers compensation, referral letters) may be overturned on appeal. Where a trial judge rejects expert evidence as 'partisan' on a basis contradicted by other uncontradicted evidence in the case, the rejection is subject to appellate scrutiny. An employer's duty of care to protect an employee from foreseeable psychiatric injury is not discharged merely because the employee has taken self-protective steps; the employer must still take reasonable steps within its own capacity, such as effecting a transfer.
