Regular payments made by a charitable organisation to a volunteer worker for daily living and accommodation expenses, intended to enable the worker to function more effectively, are not benevolent gifts to be disregarded in assessing damages but are analogous to compensation for inability to obtain employment and reduce the plaintiff's economic loss. Where a transitional provision exempts 'proceedings determined before commencement' of an amending Act, a case determined at first instance is 'determined' subject to any appeal, but the amending Act applies on rehearing only where the judgment below is set aside for reasons other than non-application of the amending legislation.
