A driver with right of way at an intersection is not necessarily negligent for failing to slow down or stop when seeing an approaching vehicle; the right of way is part of the circumstances in assessing reasonableness. Indemnity costs orders based on delinquent conduct must be limited to the additional costs caused by that conduct, not extended to all costs of the proceedings. Bullock or Sanderson orders require a proper basis in the unsuccessful defendant's conduct having contributed to the maintenance of proceedings against the co-defendant.
