A permanent injunction restraining publication of allegedly defamatory material cannot be granted without a final hearing on the merits at which the plaintiff establishes an actionable defamation to which the defendant has no defence. Abandoning a damages claim and seeking only injunctive relief does not relieve the plaintiff of this obligation. An interlocutory injunction in defamation must bear upon the specific case alleged and indicate the conduct enjoined with sufficient particularity, rather than being framed in broad terms that leave issues for determination on a contempt proceeding.
