A development consent is constituted by the consent authority's determination under s 80(1) of the EPA Act, not by the notice of determination under s 81(1). Where there is an inconsistency between the two, the determination prevails. Practitioners and developers cannot rely on the face of a notice of determination where it does not accurately reflect the consent authority's actual decision.
