When assessing future economic loss where a plaintiff's earning capacity depends on the outcome of future treatment, the court must assess the likely effectiveness of that treatment by reference to possibilities (Malec), not on the balance of probabilities. Where expert evidence indicates that the prospects of substantial recovery are less than 50%, a finding of significant restoration of earning capacity without addressing that evidence constitutes error. Section 126 of the MAC Act does not displace the general law requirement to assess future hypothetical events by reference to possibilities.
