A magistrate's ruling on a preliminary question of law in summary proceedings does not constitute an 'interlocutory order' within s 53(3)(b) of the Crimes (Appeal and Review) Act 2001, and therefore cannot be the subject of an interlocutory appeal to the Supreme Court. Defendants who wish to challenge such rulings must wait until after conviction and appeal under s 52(1) or s 53(1). Section 53(3)(a) similarly cannot be read as conferring a right of appeal against a mere 'decision' in committal proceedings.
