UCPR r 15.12 (particulars in personal injury cases) does not apply to s 151Z(1)(d) workers' compensation indemnity proceedings, and orders for particulars 'in accordance with' that rule are inappropriate in such proceedings. The onus of proving the damages payable by the putative tortfeasor rests on the plaintiff employer. To obtain an order for further particulars, a defendant must demonstrate potential prejudice from having to prepare for trial without sufficient detail of the claim, not merely point to apparent inconsistencies in the plaintiff's evidence.
