A vendor who is not ready, willing and able to perform a concurrent obligation cannot be found to have failed to mitigate loss by abandoning a claim to enforce the counterparty's reciprocal obligation. An offer by an intending purchaser in an arm's length transaction is admissible evidence of the value of land and may be preferred over expert valuation evidence where the expert valuations are based on flawed assumptions.
