Pre-sentence custody may be demonstrably taken into account by a sentencing judge acceding to a defence submission to reduce the sentence below a threshold and suspend it, without the need for explicit identification of a 'starting point' in the remarks on sentence. Where the original sentencing judge has taken pre-sentence custody into account in this manner, a judge revoking a good behaviour bond is not required to backdate the sentence to give further credit for the same period.
