The Crimes (Sentencing Procedure) Act 1999 (NSW) does not permit the imposition of a single 'global' non-parole period across multiple counts; individual non-parole periods must be set. Where multiple counts of fraud involve vastly different sums, the sentencing judge must differentiate between the sentences to reflect the different levels of criminality in accordance with Pearce v The Queen. Where cumulative sentences produce a non-parole period exceeding the statutory ratio, that of itself may constitute special circumstances, and any departure from the statutory ratio requires explanation.
