An offender whose parole has been revoked and for whom an arrest warrant has been issued, but who is unaware of the revocation and whose original sentence has expired, is not on 'conditional liberty' for the purposes of the Ponfield guideline factors. The expression 'at large' in s 171(3) of the Crimes (Administration of Sentences) Act 1999 (NSW) simply refers to not being in custody and does not create a form of conditional liberty. Remorse under s 21A(3)(i) is established upon proof of acceptance of responsibility and acknowledgment of loss; the absence of additional cooperation with authorities does not reduce the mitigating value of remorse, though such cooperation may increase its weight.
