The principle that the weight to be given to youth in sentencing does not vary depending on the seriousness of the offence (from R v Hearne) should not be understood as formulating a constant factor applied in every case without variation to reflect the nature of the crime and circumstances of its commission. Where a young offender conducts himself like an adult in committing a crime of violence, deterrence and retribution may properly be given greater weight.
