Sentences imposed under the former penalty regime for hydroponic cultivation of cannabis (where the commercial quantity was 250 plants) are not apt comparators for sentences under the post-14 July 2006 regime (where the commercial quantity for enhanced indoor cultivation is 50 plants). Offences under the new regime are prima facie more serious than like offences under the former regime. A sentence of 3 years (18 months NPP) for a low-level participant cultivating 112 plants (just over twice the commercial quantity) is within range.
