An agreed statement of facts tendered for sentencing purposes must not include material that would establish a more serious offence carrying a higher maximum penalty than the offence charged. Where such material is included and relied upon by the sentencing judge, the sentence will be quashed and reimposed on the proper factual basis, though the overall effective sentence may remain unchanged if the totality of criminality was correctly assessed.
