Self-induced intoxication from drugs and alcohol, where the offender knew the drugs made him paranoid and edgy and voluntarily carried a loaded firearm to a public venue, does not significantly mitigate the objective seriousness of a s 33 offence. A strong subjective case including Aboriginal background, deprived upbringing, and drug addiction must be weighed against the gravity of the offending conduct and consequences for the victim. A starting point of 16 years (before 25% plea discount) for a near-fatal shooting with a firearm was not manifestly excessive.
