A sentencing judge should be loath to determine that a case falls into the worst category where the Crown has not submitted to that effect. The sentence imposed for aggravated sexual intercourse without consent (s 61J Crimes Act 1900) must be proportionate to the objective gravity of the offence, and statistical material from the Judicial Commission, while subject to well-known limitations, may be used to demonstrate manifest excess.
